Terms and Conditions

Scope of application

These terms and conditions apply to all contracts for the delivery of goods concluded between consumers and businesses via the online shop petwellmart.de.
Any differing terms and conditions of the customer shall only apply if we expressly agree to them in writing.

Product presentations in the shop are non-binding invitations to place an order. Customers submit an offer by clicking “Buy” in the order confirmation. Acceptance occurs upon our shipping confirmation.

Prices agus Payment Terms

Our prices include VAT and are subject to any applicable shipping costs. These will be displayed during the order process.
Payment options include prepayment, PayPal, credit card, and/or invoice – where offered.
For prepayment, payment is due within 7 to 14 days of order receipt; otherwise, we reserve the right to cancel the order.

Protection and Transportation

Unless otherwise stated, shipping takes place within 1–3 business days after receipt of payment. Delivery is within Germany; for deliveries to other countries, delivery times may vary.
For consumers: Risk and danger pass to the recipient only upon handover of the goods. For businesses, risk passes to the transport company upon handover (§ 447 BGB).
In the event of an unsuccessful delivery attempt, the customer shall bear any additional shipping costs incurred (except in the case of a valid cancellation).

Self-Precaution

The delivered goods remain our property until full payment has been received.

Justice Broad (Judge)

Consumers have a 14-day right of withdrawal – starting from the date of delivery or receipt of the last partial delivery.
To exercise this right, the customer must clearly inform us of their decision within this period (e.g., by letter). A sample form is provided.
After withdrawal, we will refund payments, including standard delivery costs (excluding additional costs for non-standard shipping options). Refunds will be issued within 14 days, using the same payment method as the original purchase. Refunds may be withheld until proof of return or receipt of the goods has been provided.
Return shipping costs are the responsibility of the customer, unless otherwise stipulated by law.

Commitment and Liability

The statutory warranty rights apply (§ 437 German Civil Code). For businesses, shorter warranty periods apply (e.g., 1 year for new goods).
Our liability is unlimited in cases of intentional misconduct, gross negligence, and injury to life, body, or health. In cases of slight negligence, we are only liable for breaches of essential contractual obligations and only up to the amount of typically foreseeable damages.
Further claims are excluded to the extent permitted by law.

Subject of the contract and product features

The subject of this contract is the sale of pet supplies.
Essential product characteristics can be found in the respective product description – especially in cases of differing specifications.

Applicable law, place of jurisdiction

German law applies unless mandatory consumer protection regulations stipulate otherwise. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
For businesses or customers without a residence in Germany, the place of jurisdiction is the registered office of our company, to the extent legally permissible.

Alternative route

The European Commission provides information on online dispute resolution (ODR) at  https://ec.europa.eu/consumers/odr  . We are currently not obligated, but willing, to participate in dispute resolution proceedings before consumer arbitration boards.

Severability clause

Should any provision of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. Statutory provisions shall remain in effect.
